Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your access to and use of the Opsify website, applications, and related services (collectively, the "Services") provided by Opsify ("Opsify," "we," "us," or "our"). By using the Services, you agree to these Terms. If you do not agree, do not use the Services.

2. Eligibility and accounts

You must be able to form a binding contract in your jurisdiction. You are responsible for the security of your account credentials and for all activity under your account. Notify us promptly of any unauthorized use.

3. Description of the Services

Opsify offers tools and AI-assisted features to help you observe and manage Kubernetes environments. Features may change over time. The Services are provided for informational and operational assistance; automated suggestions may be incomplete or incorrect, and you remain responsible for decisions and actions in your infrastructure.

4. Acceptable use

You agree not to:

  • Use the Services in violation of law or third-party rights;
  • Attempt to probe, scan, or test the vulnerability of the Services, or bypass security or usage limits;
  • Reverse engineer, decompile, or attempt to extract source code or models except where applicable law permits;
  • Use the Services to develop competing products by scraping or systematically extracting training data without permission;
  • Interfere with or disrupt the Services or other users' access.

5. Fees, credits, and billing

Paid features, credits, or subscriptions are described on our pricing page. Fees are charged as shown at checkout. Unless stated otherwise, fees are non-refundable except where required by law. We may change pricing or plans with reasonable notice.

6. Intellectual property

Opsify and its licensors retain all rights in the Services, branding, and related content. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to use the Services for your internal business purposes. You retain rights in data you submit; you grant us a license to use that data as needed to provide and improve the Services.

7. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE OR THAT OUTPUT FROM AI FEATURES WILL BE ACCURATE OR SUITABLE FOR YOUR USE CASE.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OPSIFY AND ITS SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (USD $100), IF NO FEES APPLIED. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES OUR LIABILITY IS LIMITED TO THE MAXIMUM PERMITTED BY LAW.

9. Indemnity

You will defend and indemnify Opsify against claims arising from your use of the Services, your content, or your violation of these Terms, to the extent permitted by law.

10. Termination

You may stop using the Services at any time. We may suspend or terminate access if you materially breach these Terms or if we need to do so to comply with law or protect the Services. Provisions that by their nature should survive will survive termination.

11. Governing law and disputes

These Terms are governed by applicable law, without regard to conflict of law rules. Courts in the jurisdiction where Opsify is organized may have exclusive jurisdiction over disputes, unless mandatory consumer protections in your country say otherwise.

12. Changes

We may modify these Terms from time to time. We will post the updated Terms on this page and update the "Last updated" date. Continued use after changes constitutes acceptance of the revised Terms where permitted by law.
